Informal Resolution First
Before initiating any formal proceeding, the user and WritingToolsPro agree to attempt good-faith resolution by writing to legal@writingtoolspro.com with a description of the dispute and the requested resolution. Most disputes are resolved at this stage.
Governing Law
Disputes are governed by the laws of the jurisdiction stated in the user's customer agreement (for paid customers) or the laws of the U.S. state in which Relationale LLC is headquartered (for free users), without regard to conflict-of-laws principles.
Venue
Subject to any enforceable arbitration provision, disputes shall be brought exclusively in the state and federal courts located in the applicable jurisdiction, and the parties consent to personal jurisdiction there.
Arbitration (Where Applicable)
Where an enforceable arbitration provision applies, disputes are resolved by individual binding arbitration under the rules of a recognized arbitral institution. Class actions, class arbitrations, and representative actions are waived to the maximum extent permitted by law.
Equitable Relief
Either party may seek injunctive or other equitable relief in court to protect intellectual property or confidential information, notwithstanding the foregoing.
Time Limit
Any claim arising out of or relating to the platform must be filed within one year after the claim arose, or be permanently barred, to the maximum extent permitted by applicable law.
